Hausse des frais universitaires en France : le Conseil constitutionnel confirme le principe de gratuité de l’enseignement supérieur

Bien que symbolique, la décision rendue vendredi 11 octobre par le Conseil constitutionnel français sonne comme un désaveu de plus pour le gouvernement qui a augmenté les frais universitaires des étudiants étrangers non-européens en avril dernier et fait face à une fronde universitaire.

C’est un nouveau rebondissement dans l’interminable débat sur la hausse des frais universitaires annoncée en France en novembre 2018 dans le cadre d’une nouvelle stratégie d’attractivité baptisée « Bienvenue en France ». La conformité constitutionnelle de l’arrêté inscrit au Journal officiel en avril 2019 prévoyant de de relever à 2 770 euros, les frais universitaires en licence et à 3 770 euros, ceux de masters pour les étudiants non-européens, a été étudié par le Conseil constitutionnel qui a rendu sa décision vendredi 11 octobre.

Verdict : le principe de gratuité de l’enseignement figurant dans le préambule de la Constitution du 27 octobre 1946, vaut aussi pour l’enseignement supérieur, affirme la plus haute juridiction française.

Une décision non-contraignante

L’institution a été saisie en juillet par plusieurs organisations étudiantes françaises après qu’elles ont décidé de contester l’arrêté devant le Conseil d’État. Avant de statuer, ce dernier a décidé que le Conseil constitutionnel devait d’abord analyser la constitutionnalité du texte.

En consacrant le principe de gratuité de l’enseignement supérieur, les juges constitutionnels français contredisent frontalement le gouvernement, sans pour autant l’obliger à revenir sur sa réforme : « Cette exigence ne fait pas obstacle, pour ce degré d’enseignement, à ce que des droits d’inscription modiques soient perçus en tenant compte, le cas échéant, des capacités financières des étudiants », précise la décision en rappelant qu’ « il appartient aux ministres compétents de fixer sous le contrôle du juge les montants de ces droits. »

Fronde universitaire

Ce n’est pas le premier revers que connaît le gouvernement français suite à la hausse des frais universitaires. Depuis cette rentrée, seuls sept universités hexagonales (Paris II-Assas, Bordeaux, Bretagne Sud, Grenoble Alpes, Lille, Orléans et Rennes 1) sur 75 appliquent la mesure qui, dès son annonce en novembre, avait suscité une vague de protestation chez une quinzaine de présidents d’institutions françaises.

Huit d’entre elles (Rennes 2, Lyon 2, Toulouse Jean-Jaurès, Nanterre, Angers, Aix-Marseille, Clermont-Auvergne, Rouen-Normandie) ont recours à un décret de 2013 qui permet d’exonérer 10 % des inscrits (hors étudiants boursiers et pupilles de la nation) de frais de scolarité en fonction du cycle, et du pays de provenance.

Mi-septembre, l’université Lyon 2 a confirmé à Jeune Afrique qu’« elle continuera à exonérer les étudiants concernés, tant qu’elle pourra rester dans la limite des 10 % exonérés par rapport à l’effectif total ». L’université de Pau maintient également sa position, rappelant qu’elle ne fait qu’appliquer un texte prévu dans la loi. « Il ne s’agit pas de contourner la réglementation. Nous sommes en dessous des 10 %, donc nous respectons la loi. Si nous dépassons ce quota l’année prochaine, alors nous appliquerons la hausse », note Mohammed Amara, président de l’université de Pau.

« Opposition de principe »

La majorité des établissements a formulé « une opposition de principe » notamment par peur de voir le nombre d’étudiants diminuer. Le ministère de l’Enseignement supérieur annonce que « le nombre d’étudiants internationaux inscrits en 2019, après l’examen des demandes de visas, a augmenté de 2,4 % ». De leurs côtés, plusieurs universités, comme Rennes 2 et Aix-Marseille, attendent la fin des inscriptions pour savoir s’il y a eu une hausse ou une baisse des étudiants internationaux cette année.

En février 2019, soit trois mois après l’annonce de la réforme, Campus France, organe dépendant des ministères français des Affaires étrangères et de l’Enseignement supérieur, a enregistré une hausse des candidatures provenant d’Afrique de l’Ouest et une baisse au Maghreb. Les chiffres concernant les inscriptions définitives se font encore attendre.

PERSON SPECIFICATION EDUCATION & QUALIFICATIONS
  • The postholder must be a national of an African country and between 24 and 32 years old at the date of application.
  • A Bachelor's Degree in a relevant area for the post is essential. A Master's Degree is desirable.
  • Fluency in English and French with excellent oral and written communication skills in both languages is essential.
  • A minimum of one year of work experience relevant to the job description i.e., in the fields of finance, resource mobilization, grants management, advocacy or health - in particular aspects of sexual and reproductive health and rights -, is desirable.
  • Fluency in Microsoft Office is essential. Experience of Netsuite is desirable.
PROVEN ABILITY
  • Demonstrated commitment and passion for ensuring universal access to healthcare for all and SRHR in particular is desirable.
  • Experience of studying or working outside of the home country is an advantage.
  • Willingness to work in multicultural environments and ability to successfully interact with individuals of different cultural backgrounds and beliefs. The post holder must show tolerance and acceptance of different views and opinions.
